Terms of Service

These Terms of Service ("Terms") govern your use of Spot Check ("we", "our", "us"), a playlist validation browser extension and related services operated by Total Audio Promo Ltd, a company registered in England and Wales.

By using Spot Check, you agree to these Terms. If you do not agree, please do not use our services.

1. Definitions

• "Service" means the Spot Check browser extension, website (spotcheck.cc), and any related APIs or tools.
• "User", "you", or "your" refers to any person accessing or using the Service.
• "Subscription" means a paid plan (Premium or Pro) that provides enhanced features.

2. Service Description

Spot Check provides playlist validation tools for Spotify, including:

• Playlist metrics analysis (followers, tracks, curator information)
• Bot detection and risk scoring
• Historical tracking and change alerts
• Bulk validation and export capabilities

We access only publicly available Spotify data. We do not access your personal Spotify account, listening history, or private playlists.

3. Account Registration

To access paid features, you must create an account by providing a valid email address. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorised use

4. Subscriptions and Payments

4.1 Subscription Plans

We offer the following subscription tiers:

• Free: Limited features, no payment required
• Premium: Enhanced features at the current advertised price
• Pro: Full features including API access at the current advertised price

4.2 Payment Processing

Payments are processed securely by Stripe. By subscribing, you agree to Stripe's terms of service. All prices are displayed in GBP and include VAT where applicable.

4.3 Billing Cycle

Subscriptions are billed monthly on a recurring basis. Your subscription will automatically renew unless cancelled before the renewal date.

4.4 Cancellation

You may cancel your subscription at any time through your account settings or by contacting us. Upon cancellation:

• You retain access to paid features until the end of your current billing period
• No refunds are provided for partial billing periods
• Your account reverts to the Free tier after the billing period ends

4.5 Refunds

We offer refunds at our discretion within 14 days of initial purchase if you have not substantially used the Service. Contact us at hello@spotcheck.cc to request a refund.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to circumvent usage limits or access controls
• Reverse engineer, decompile, or disassemble the Service
• Share your account credentials with others
• Use automated tools to scrape or harvest data beyond normal extension use
• Interfere with or disrupt the Service or its infrastructure
• Violate Spotify's terms of service while using our Service

6. Intellectual Property

All intellectual property rights in the Service, including software, design, branding, and content, belong to Total Audio Promo Ltd or our licensors. You are granted a limited, non-exclusive, non-transferable licence to use the Service for its intended purpose.

7. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to our data practices as described in that policy.

8. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

• Merchantability or fitness for a particular purpose
• Accuracy, reliability, or completeness of playlist data or analysis
• Uninterrupted or error-free operation

Playlist validation results are informational only and should not be the sole basis for business decisions. We do not guarantee the accuracy of bot detection or risk scores.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability for any claim arising from your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim
• We are not liable for any loss of profits, revenue, data, or business opportunities

10. Indemnification

You agree to indemnify and hold harmless Total Audio Promo Ltd and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

11. Modifications to Service and Terms

We reserve the right to:

• Modify, suspend, or discontinue the Service at any time
• Update these Terms with reasonable notice
• Change subscription prices with 30 days' notice to existing subscribers

Continued use of the Service after changes constitutes acceptance of the modified Terms.

12. Termination

We may suspend or terminate your access to the Service immediately if you breach these Terms. Upon termination:

• Your right to use the Service ceases immediately
• You remain liable for any outstanding payments
• Provisions that should survive termination (including limitations of liability and governing law) shall survive

13. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Total Audio Promo Ltd regarding the Service and supersede any prior agreements.
